Bhim Singh upset on CJI’s direction to CPM Chief on his visit to Kashmir

New Delhi, 28th August 2019 : Prof. Bhim Singh, Sr. Advocate & Sr. Executive Member of Supreme Court Bar Association (SCBA) who is also the Execcutive Chairman of State Legal Aid Committee, J&K which has been agitating for the application of fundamental rights in J&K for decades.

Prof.Bhim Singh today expressed shock on the statement of Chief Justice of India, Mr. Ranjan Gogoi who heard a petition filed by CPM General Secretary, Mr. Sita Ram Yechury. Mr. Yechury had filed the application before the Supreme Court of India seeking its intervention to ensure that the CPM leader shall be allowed to visit Kashmir to see his party’s J&K Secretary, Mohd. Yousuf Tarigami who is detained by J&K Police.

The Chief Justice of India asked Mr. Yechury that,

“We will permit you to go (Kashmir). You are General
Secretary of a party. Don’t go for anything else.”

The Supreme Court further observed that

“Mr. Yechury should meet Tarigami (prisoner) as a friend and
not for any political purpose.”         

Prof.Bhim Singh who has been released dozen of time by the
orders of the Supreme Court when he was detained by the Govt. of J&K under
its Detention Laws in past. He expressed surprise saying,

“I am deeply shocked on the observation made by the Hon’ble
Chief Justice of India directing the CPM Chief that, “We will permit you to
go”… “Don’t go for anything else”…

Prof.Bhim Singh who has been pleading several writ petitions
for the release of prisoners detained under J&K Public Safety Act. It was
Supreme Court which always granted relief to all prisoners whose detention was
found unconstitutional.

He said that the Supreme Court of India heard an application
filed by CPM Chief Mr. Sita Ram Yechury, sitting Member of Parliament, seeking
permission to visit Kashmir to meet his colleague wherever he (Tarigami) has
been detained/lodged in illegal detention. Mr. Tarigami with other 11 political
leaders and parliamentarians who flew to Srinagar couple days back was packed
by the J&K Police and sent back to Delhi along with other 11 opposition
leaders. He expressed surprise that Supreme Court of India is attaching conditions
on the visitors to visit Kashmir which never happened in the history.

Prof.Bhim Singh urged the Supreme Court Bar Association of India to hold an urgent meeting of the SCBA to discuss this matter relating to human rights and rule of law.
